Submitting a VA Claim in San Antonio

To apply for disability benefits from the VA, you will need to go through the VA claims process. The process, which is often a lengthy and drawn-out, is required to receive disability compensation. The process begins when a Veteran submits a VA disability claim. This can be done from any location in the entire world. Where you served or currently reside has no impact on the claims process. To apply, you need to complete VA Form 21-256EZ or apply online through the VA eBenefits portal.

Unfortunately, a San Antonio VA appeals lawyer from Berry Law cannot help with the filing of an initial claim. We often recommend Veterans seek the help of a local Veterans Service Officer (VSO) when filing an initial claim. Upon receiving your claim, the VA will then issue a decision, known as a Rating Decision. This usually takes about six months from the date the claim was filed.

After the Veteran receives a rating decision, they have a couple of different options. First and foremost, if the Veteran is satisfied with the rating the VA has given them, there are no further steps. The VA will begin sending compensation to the Veteran in the form of monthly payments. However, if you are not satisfied with the rating the VA gave you, you are entitled to appeal the decision.

Appealing a Rating Decision in San Antonio

This is the first step in the claims process that you can seek the assistance of a San Antonio VA disability lawyer on our team. We are happy to help fellow Veterans appeal their decision, and we understand what appeals to file and the benefits of each route. The different appeal routes are now known as appeal lanes, which were implemented in 2019 after the passing of the VA Appeals Modernization Act (AMA).

The AMA gives Veterans multiple different lanes to appeal their decision through. The Veteran can appeal through the Higher-Level Review Lane, the Supplemental Claim Lane, or Appeal to the Board of Veterans Appeals.

  • Higher Level Review – A Veteran can use this lane to appeal a decision if they wish to have a more senior level VA claims adjudicator review their claim. However, you cannot submit any additional evidence for your appeal.
  • Supplemental Claim Lane – In this lane, a Veteran is entitled to submit “new and relevant evidence” in support of their claim.
  • Appeal to the BVA – Veterans appealing to the board have three options. They can submit additional evidence, ask for a direct review, or ask for a hearing in front of a Veterans Law judge.

Each lane has it’s benefits and downsides. An experienced San Antonio VA disability lawyer could help you determine the most effective route to utilize.

Selecting a VA Accredited Attorney in San Antonio

Not all VA appeals attorneys in San Antonio are the same. When you are searching for an attorney, it is a good idea to select one who has experience working VA disability claims. A lengthy history often translates to superior work product, but not always. It is often a good idea to look at your firm’s testimonials, check out their online reviews, and even ask your lawyer what some of their most effective arguments have been in the past

A San Antonio VA appeals lawyer from Berry Law will help simplify the appeals process. We have represented thousands of Veterans with all sorts of disability claims. Our team has representatives in multiple cities throughout the US, but the location of your attorney does not impact the claims process since it is Federal in nature. Therefore, you do not actually need a VA disability lawyer in San Antonio. In fact, our team has helped Veterans in every state in the US and have even helped Veterans living in foreign countries.
