What is VA Form 10182? Understanding the Notice of Disagreement (NOD) 

If you’ve received a VA decision on a disability claim that you believe is inaccurate or unfair, VA Form 10182, known as the Decision Review Request: Board Appeal (Notice of Disagreement), offers a formal way to appeal. Introduced under the 2019 Appeals Modernization Act (AMA), VA Form 10182 allows Veterans to request a Board of Veterans’ Appeals (BVA) review by a Veterans Law Judge (VLJ) to potentially overturn or adjust the VA’s initial ruling. 

When to Use VA Form 10182 

Veterans can use VA Form 10182 to appeal decisions on VA benefits claims if they are unsatisfied with the outcomes from the initial claim, a supplemental claim, or a higher-level review. This form must be filed within one year of the VA decision date to ensure eligibility for appeal. 

The Three Appeal Options on VA Form 10182 

  1. Direct Review: If you believe the decision was wrong based on the evidence already submitted, you can choose the Direct Review option, which is typically faster as it doesn’t involve new evidence or hearings. This path is ideal for Veterans who think there was an error in judgment rather than a need for more documentation  
  1. Evidence Submission: This option allows you to submit new evidence to support your appeal. If you have additional documentation that strengthens your claim, the VLJ will review it alongside the existing case materials. This option extends the processing time but might improve your appeal’s success rate if the new evidence is compelling. 
  1. Hearing with a Veterans Law Judge: Choosing this option allows Veterans to meet with a VLJ, either in person or virtually, to discuss their case. Veterans can submit evidence up to 90 days after the hearing. While this can be the most persuasive method, wait times are generally longer due to the demand for VLJ hearings. 

How to Complete VA Form 10182 

The form includes four main sections: 

  1. Personal Information: This covers details like your name, VA file number, and contact information. 
  1. Board Review Option: Here, select one of the three review options: Direct Review, Evidence Submission, or Hearing. 
  1. Specific Issues for Appeal: Clearly list the decisions you’re contesting, including the issue and the date of the VA’s decision. 
  1. Certification and Signature: You must sign and date the form to certify your appeal. 

Submission and Timelines 

VA Form 10182 can be submitted via mail, fax, or through an online portal. Remember, the VA typically takes several months to over a year to process appeals. The Direct Review path usually yields the fastest decisions, but any Board Appeal could require a significant wait time due to the high volume of cases.
